America delineates criminal activity based on the severity of the crime, and the level of correction reflects the seriousness of the conviction. Felonies or serious crimes may merit prison time and restitution. Misdemeanors may merit jail time, probation, or restitution. In the same vein of checks and balances, inmates and those on probation or parole have certain procedural protections.
Prison
Defendants sentenced to prison complete processing steps upon their entry into the corrections system. Prisoners receive an orientation that instructs them on prison rules and policy. Upon integration, prisoners may receive work furloughs or home arrest. The Board of Clemency holds hearings determine the inmate’s eligibility. Some prisoners work within the prison system and earn money or privileges for their labors. The prison system does not allow rule or law breaking. Should this occur, the inmate may face reduced prison campus privileges, criminal charges, or denial of parole.
Parole
When prisoners serve a specified amount of their sentence, they may apply for parole. Parole indicates release from prison with stipulations regarding maintaining particular conduct for a certain amount of time. The prisoner must apply for parole and explain the reasons to justify the release at a hearing. If release is granted, the parolee must follow rules or conditions of parole. While on parole, the parolee must check in with a parole officer and wear a global positioning tracking device, or be held to additional requirements. If a parolee violates the conditions, a parole officer may initiate proceedings before the judge to revoke the parole. If the judge concurs, the defendant returns to prison. If the person fulfills all of release requirements, does not incur additional violations of the parole rules, or reaches the allotted parole duration date, the individual may be discharged from parole.

Probation is a form of correction whereby the defendant agrees to rules of behavior for a specific time frame to pay the debt to society for the criminal wrongdoing. Generally, a probation officer monitors and supervises a defendant on probation. The person generally remains free from incarceration. If violations of probation conditions occur, the probation ends, and the person serves jail time in lieu of the probation; however, the jail time may not exceed one year. If justice is served, the court has authority to end probation early when the probationer’s conduct merits release.
