Students must critically answer the question: Is contractual liability related to construction claims?
– Types of liability involved in the UK construction industry (contract and tort);
– The relationship between liability, governmental changes, bankruptcy and global financial crisis;
– Liability towards employees;
– Liability to third parties;
– Design liabilities;
– Disputes involving liabilities.
The essay must be consistently written as follows:
• Introduction with the general topic, aims and objectives, proposed critique and findings;
• Evidence of literature and overall research about the topic. Students must make sure they are not referring to Wikipedia, online blogs and firms’ reports, since these sources are not academic;
• Discussion in which students must bring the core issues and the reason why they should be researched/ discussed/ exposed, and the way the construction industry has historically approached the topic; the discussion must be framed in time and space;
• Present critical analysis of the content;
• Conclusion that summarises all the issues raised in the essay.
